Terms & Conditions
Once you have chosen a program, please read the terms and conditions as your booking is subject to the terms listed below. Payment of a reservation for any program or tour of ESCAPATE PERU will constitute consent to all provisions of the Booking Terms and Conditions set forth in this document and is binding for all tours.
General
The program may change according to weather conditions as well as the wishes of the group.
ESCAPATE PERU is not responsible for any loss or damage to the client’s personal belongings or any consequences due to loss or damage.
We cannot assume responsibility for any illness or accident that may occur. In case of illness or accident, responsibility and associated costs will fall on the client.
The client is responsible for any equipment lent to them, the total cost of damages or losses must be compensated upon return from the excursions.
The client declares to be in good physical and mental condition. ESCAPATE PERU is not responsible for the consequences if this is not the case.
Booking Procedures (Deposit)
Please contact us before making any payment. A 50% deposit per person for the chosen program is required at the time of booking. This deposit is non-refundable in case of cancellation by the client. By doing this you enter into a contract with ESCAPATE PERU. We accept and confirm the reservation. Please note that travel arrangements are not confirmed until ESCAPATE PERU indicates so in writing.
This 50% prepayment can be made through WESTERN UNION, PAYPAL or Online payments. The transfer will be made in the name of ESCAPATE PERU staff.
ESCAPATE PERU will NOT pay bank taxes or transfer costs. All transfer costs must be paid by the client.
Final Balance Payment
The program price is in US dollars.
We require you to pay your final balance at our office at least 24 hours before your tour. We currently accept cash (Peruvian soles or US dollars) and Visa (8% commission charge applies).
The program price per person is agreed upon at the time of booking confirmation and will not increase or decrease.
Cancellation on Your Part
In case of cancellation by the client, this must be notified to ESCAPATE PERU in writing. Please note that the deposit is non-refundable. Please indicate the reason for cancellation as it may be covered by your insurance policy.
If cancellation notification is received more than 15 days before departure, the client will lose the 50% deposit. From 15 to 7 days before departure, 50% of the trip price will be refunded only if 100% is paid in advance. Less than 48 hours before departure, no money will be returned, nor in case of cancellation of only part of the tour.
Cancellation / Changes on Our Part
Circumstances beyond our control: technical problems, weather conditions, strikes, riots and government decisions.
In such cases, ESCAPATE PERU will propose solutions to operate the program or comparable travel arrangements but will not refund money. We reserve the right to alter the scheduled itinerary accordingly. We will make all reasonable efforts to provide you with the booked program arrangements but changes may occur.
If they are significant, we will inform you, if possible, before the departure date. Again, we will offer you comparable alternatives. All additional expenses incurred will be borne by the client. Please note that ESCAPATE PERU will not be responsible for reimbursing additional expenses made by the client in preparation for the tour, this includes international tickets and fees, cost of visas, vaccinations, among others.
Cancellations caused by ESCAPATE PERU: we will refund 100% of your payment.
Risk Acceptance
Some of ESCAPATE PERU’s itineraries have been designed to provide participants with exposure to the true nature of the environment visited. Therefore, they involve an element of personal risk, which could result in physical or emotional injury, paralysis, death or damage to the client, their property or third parties. The client understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity and therefore assumes them as part of the trip. The client accepts that they are aware of their physical and health condition and that, with knowledge of this, decides to assume the mentioned risks. The client excludes ESCAPATE PERU from all liability linked to any accident or injury that could occur.
Authority on Tour
At all times the decision of the guide or company representative will be final in all matters that may endanger the safety and welfare of the tour group. The client must follow the guide’s instructions at all times.
The client must strictly comply at all times with Peru’s laws and regulations regarding drugs. If the client fails to comply with the above, or if the client interferes with the welfare of the group, then the guide or company representative may order the client to leave the tour without any refund.
Travel Documents
The client must be in possession of a valid passport. The original document or at least a copy must be carried on the tour.
Travel Insurance
We strongly advise you to take out travel insurance that covers accidents, medical expenses and emergency repatriation, including rescue and air ambulance. We also recommend that you cover cancellations and loss of luggage.
Third Party Services
ESCAPATE PERU directly operates part of the services included in a program but also makes arrangements with airlines, hotels and other independent parties to provide you with the travel services you purchase. We take all reasonable measures to ensure that the organizations providing the services maintain our quality standards. However, these parties are independent suppliers over which we do not have total direct control.
Therefore, ESCAPATE PERU cannot accept any responsibility for losses, damages, inconveniences, delays, etc.
Claims and Complaints
If a client has a complaint against the company, the client must first inform the guide during the tour so that the guide can attempt to rectify the matter. Any other claims must be submitted in writing to the company within 7 days of trip completion.
Jurisdiction for all claims or disputes will be exclusively in Cusco, Peru, whose courts, using Peruvian law, will have exclusive jurisdiction.
Claims for damages against ESCAPATE PERU will be limited to the value of the particular item in dispute. Any liability is limited to the total price paid for the tour. In all cases the company specifically excludes all liability for indirect, incidental or consequential losses or expenses, including lost profits.
